Madison Co. Prosecutor prepares to handle deadly crash case

ANDERSON, Ind. (WISH) – An Edgewood officer is out of jail and on administrative leave after police said he caused a deadly crash.

J.D. Foutch bonded out of jail Monday morning. 24-Hour News 8 stopped by his home, but he didn’t answer. The Madison County Prosecutor did speak, however, as he prepares to handle this case.

“It’s still very tragic when one of our own lets us down like this,” said Rodney Cummings.

Prosecutor Cummings is talking about Officer Foutch. Investigators said the 41-year-old police officer rear-ended a car causing a deadly crash on State Road 32, north of Lapel Sunday afternoon. The crash killed Jesse Sperry, a passenger inside the car and injured his 9 months pregnant wife Rebecca, who was driving.

“Very sad for our community..there really isn’t much to say,” Cummings said.

Investigators said Foutch was off-duty and in his personal car when the crash happened. He’s facing charges of operating while intoxicated causing death.

“He’s going to be responsible for his actions,” Cummings said.

Cummings said right now investigators are waiting on toxicology results from blood tests before they proceed.

“We’re waiting for the investigation to be completed and that hasn’t happened. We’re serving search warrants for drug history, script records,” he said.

As for the victims, Rebecca, was induced Saturday afternoon and delivered a healthy baby girl, named Autumn. Family members told 24-Hour News 8 Autumn and Rebecca are going to be OK.
