Charges dropped in deadly Coke Lot shooting

INDIANAPOLIS (WISH) — Court documents show a man arrested in a deadly shooting at the Coke Lot during Indianapolis 500 race weekend has been released.

19-year-old Avory Johnson was in custody on a preliminary murder charge. The charge has been dropped.

The shooting happened early Saturday morning. 25-year-old Max Levine, of Kokomo, was killed.

A spokesperson with the Marion County Prosecutor’s Office sent the following statement to 24-Hour News 8 Wednesday morning:

The Marion County Prosecutor’s Office has completed a review of the evidence from the May 24, 2014 shooting in the Coke Lot in Speedway, Indiana.

Due to significant inconsistencies in the identification of the suspect, criminal charges will not be filed at this time. Deputy prosecutors are continuing to work with the Speedway Police Department on this on-going investigation.

Police continue to investigate that shooting and another shooting that happened near the Speedway during race weekend.
