INDIANAPOLIS (WISH) — A man who originally avoided prison time after being convicted of raping his wife will now spend time behind bars.
In May, a judge sentenced David C. Wise to eight years of home detention. A jury found him guilty on all six counts of rape and criminal deviate conduct.
According to court documents, Wise drugged his wife with Xanax and other drugs. Once drugged, Wise would have sex with his wife. He then filmed the assaults on his cell phone, which his wife later discovered.
The prosecution had asked for Wise to be sentenced to 40 years in prison. Based on sentencing guidelines, he could have received 100 years in prison.
“I felt there is no difference if she knew him or not, she invited him into her bed, or if she didn’t, because when she laid down she was not in the wrong place at the wrong time,” said Marion County Prosecutor Courtney Curtis told 24-Hour News 8 back in May.
Court documents filed this month show Wise was in violation of his home detention sentence. On Thursday, a judge ordered Wise serve five years in the Department of Correction and three years of home detention.
Wise must also serve two years of probation and register as a sex offender for 10 years.
