Judge upholds firing of elementary principal

PETERSBURG, Ind. (AP) — A federal judge has dismissed the lawsuit filed by a former southwestern Indiana elementary school principal who was fired on grounds that he falsified student attendance records and didn’t complete teacher evaluations.

District Judge Richard Young on Wednesday sided with the Pike County School Board, ruling the decision to fire Rick Fears as Otwell Elementary School principal was lawful and supported by substantial evidence.

The Washington Times-Herald reports Fears was fired in September 2013 after district officials say he altered the records of absent students to improve the attendance rate for the school about 40 miles northeast of Evansville.

The lawsuit maintained Fears’ rights were violated because of he wasn’t allowed to challenge evidence during an administrative hearing and that hearsay evidence was used against him.
