Contractor sentenced for common wage violation

INDIANAPOLIS (WISH) – A local contractor was sentenced to two years probation for theft after having underpaid drywall installers employed for the Barton Towers project in downtown Indianapolis.

David Roark plead guilty to the charges in June. The project was a federally-funded that was subject to prevailing wage requirements under the Federal Davis-Bacon Act, which means employees must be paid the prevailing local wage.

Two of the employees were paid as low as $12.00 an hour.

As part of a plea agreement Roark must pay restitution to two employees, each will get $24,311.
