Judge: Murderer not competent for death penalty

INDIANAPOLIS (WISH) — The man who raped and murdered a Franklin College student in 1997 isn’t competent to be executed for his crimes, a judge determined Thursday.

Michael Dean Overstreet was convicted in 2000 of murdering Kelly Eckart after abducting her. He was sentenced to death, but his attorneys argued he wasn’t capable of understanding the execution.

Overstreet remains in custody and his sentence still stands. However, he can’t be executed unless at some point he’s deemed competent to have the death sentence carried out.
