City: Man in wheelchair incident likely injured beforehand

LAFAYETTE, Ind. (WLFI) – The city of Lafayette claims a man who was pushed over in a wheelchair by a police officer may have received injuries prior to the incident.

In a federal lawsuit filed in 2013, Nicholas Kincade claimed he received injuries and his wheelchair was damaged when he was pushed over.

According to court documents, Kincade told a school security officer he had been beat up or jumped over prescription pills the night before his run-in with police.

Kincade claims he was trying to get to the bus stop when Lafayette Police Officer Tom Davidson pushed him over.

The city states that Kincade ignored an order to leave the area and ran his wheelchair directly towards Davidson.

Davidson was suspended and demoted after the incident.
