Lawsuit settled after officer pushes over man in wheelchair

LAFAYETTE, Ind. (WLFI) – A federal lawsuit filed after a man who was pushed over in a wheelchair by a Lafayette police officer may soon be coming to an end.

A dashcam video from Lafayette Police Department recorded the incident on Oct. 1, 2013.

Nicholas Kincade claims he received injuries and his wheelchair was damaged when he was pushed over by Tom Davidson, who was a lieutenant at the time.

In paperwork recently filed in federal court, the mediator between Kincade, Davidson and the City of Lafayette states that the matter has been settled.

The terms are not yet known, but Kincade’s lawyer must file the paperwork with the court by mid-June.

As WISH-TV’s sister station WLFI has already reported, Davidson was demoted to the rank of officer as a result of the incident.

City attorney Ed Chosnek declined to make a comment at the latest developments, forwarding all questions to the city’s hired outside counsel.
