Lafayette settles case of 2013 wheelchair incident

TIPPECANOE COUNTY, Ind. (WLFI) – After two years, the city of Lafayette has settled its case with Nicholas Kincade.

The city announced Thursday, with help from a mediator, they have reached an agreement to resolve Kincade’s lawsuit against the city and LPD Officer Thomas Davidson.

In October 2013, Kincade was pushed over in his wheelchair by Davidson as shown in dash cam video. Kincade claimed he was hurt and his wheelchair was damaged.

The city’s insurance company has agreed to pay Kincade an undisclosed sum. Kincade has agreed to dismiss the lawsuit and release the city of Lafayette and Officer Davidson from all liability.

The parties have agreed that the settlement is not an admission of liability.
