Attorney: No word on former ‘Subway Guy’ not surprising

INDIANAPOLIS (WISH) – It’s been nearly a month since FBI agents raided the home of former Subway spokesperson Jared Fogle, and law experts tell WISH-TV it could be awhile before we learn if charges will be filed.

New allegations came out against Fogle this weekend which was shocking to some Subway customers.

“Well it was kind of outrageous to me because I got grandbabies about that age,” Indianapolis resident Reginald Batts said.

“Are you serious?” asked Tameka Copedege. “That’s not good.”

Business Insider reported the FBI asked for lewd text messages between Fogle and a Subway employee, in which Fogle talked about having sex with a 16-year-old. This comes nearly a month after agents raided Fogle’s Zionsville home.

Since then, there’s been no word from authorities, and Fogle hasn’t been charged.

Attorney Scott Devries said that he isn’t surprised.

“He’s a celebrity and he’s been a spokesman for Subway for years. If I was prosecuting the case, I’d want to make sure my ducks are in a row, and be even more careful because it’s going to have such close scrutiny in the press,” DeVries said.

While Fogle hasn’t been charged, 24-Hour News 8 does know that Russell Taylor, the former head of Fogle’s charity, is being investigated for child porn.

If charges are brought against Fogle, legal experts say one thing already hurting the defense team is the publicity this case has received, including this weekend’s allegations.

“It’s going to make it more difficult because then the public’s already heard about it,” DeVries said.

As for when something may be released, Devries says it could be awhile.

“I wouldn’t seeing this taking anywhere close to a year, but to put a time limit on it, it’s really going to depend on how much evidence that they got,” Devries said.

Calls and emails to Fogle’s attorney were not returned.

The US Attorney’s office tells WISH-TV it cannot confirm or deny an investigation of Fogle is taking place.
