Appeals court upholds Jared Fogle’s child pornography sentence

INDIANAPOLIS (WISH) — A federal appeals court has upheld Jared Fogle’s sentence on child pornography charges.

Fogle had appealed for a shorter sentence, hoping for the sentence to be thrown out. He had been sentenced to 15 years in prison last November.

Fogle’s appeal contended that the sentence was influenced by his relationship with Russell Taylor, the man who produced the child porn. He also said the court based his sentence based on his fantasies instead of actual conduct and that the court erroneously based the sentence on his “acquisition and viewing of pornography depicting children as young as six years old.”

In federal documents filed Thursday, the appeals court rejected all three of Fogle’s arguments, stating “Fogle’s claims lack merit and the district court’s sentencing decision was procedurally sound.”

The court also rejected Fogle’s claims of substantive errors.
