INDIANAPOLIS (WISH) – An Indianapolis mother has been sentenced after being found guilty of failing to get medical help for her 1-year-old.
Diamond Miller was convicted of “neglect of a dependent resulting in death” earlier this month. On Friday, she received a 20 year sentence. Miller will serve 15 years in the Department of Correction and five years in community corrections.
“The number of children who have died as a result of violence followed by the inexcusable absence of medical attention is a crisis in our community,” said Prosecutor Terry Curry.
Court documents said Miller’s boyfriend Frank Larkins III, beat 1-year-old Elijah Polk.
Polk was found dead in his home in the Willow Brook Lake apartment complex on the near northeast side of Indianapolis.
According to court documents, when emergency crews arrived on scene, Elijah had been dead for some time.
Doctors who evaluated him said if he’d been taken to the hospital at the time it happened he could have survived. They also say they found evidence Elijah had been injured before. Court documents indicate the child’s biological father had confronted Larkins and Miller in the past about Larkins “putting his hands on my son.”
Larkins will be sentenced on Oct. 7. He was found guilty of four felony counts in August.
