Ex-high school employee charged with child seduction

FORT WAYNE, Ind. (WANE) – A court document filed Tuesday in Allen Superior Court alleges that a man had sex on two occasions with a student at Wayne High School while he was employed as a special education classroom assistant. The student told police the encounters took place in her home and in a car in late October and early November of 2014.

Braxton Marvin Smith faces two counts of felony child seduction. He is no longer employed at Wayne High School. The affidavit for probable cause indicates the victim was older than 16, but younger than 18 at the time of the incidents.

Police began investigating the case on March 2, 2015 when a Fort Wayne police officer working at Wayne High School was asked to interview a student based on information from the student and the student’s parents. When the student was asked if she knew why she was being interviewed, she told the officer it was because she had been “messing around” with Braxton Smith.

The student then told the officer of the two sexual encounters, one of which took place in her bedroom early on the morning of Nov. 1, 2014 and the other encounter took place in a car on Nov. 4, 2014. According to the affidavit, Smith admitted to having the sexual encounters when interviewed by the same officer that had spoken with the student.

The affidavit indicates Smith was employed at Wayne High School from September of 2013 to March 4, 2015.

It’s not known if police are investigating whether Smith’s alleged activity was limited to the one student or if others may have been involved.
