Lawsuit to be filed after boy injured on Tippecanoe Co. playground

TIPPECANOE COUNTY, Ind. (WLFI) – A lawyer is threatening to sue after a 12-year-old boy was seriously injured on the playground at a school within the Tippecanoe School Corporation.

The incident happened in 2014 at Wea Ridge Elementary School.

According the family’s attorney, Susannah Hall-Justice, the boy fell on a metal tube that’s part of the playground equipment. He had to be flown to Riley Hospital for Children in Indianapolis because of his injuries.

Hall-Justice said tort claims notice has been filed, which has to be done when someone has a claim for injury against the state of Indiana. The notice states they are seeking $700,000 for the serious, nearly fatal injuries.

Hall-Justice said a formal lawsuit will be filed in the next month.

She was in front of the school board Wednesday night with concerns that the tube hasn’t been removed.

“That metal tube is still sticking out of the ground in the same position, in the same place where a child can fall on it. And hundreds of kids play on this playground, so I don’t understand why this hasn’t been moved. It’s a cheap, easy fix,” Hall-Justice said.

Sue Scott, TSC’s communications coordinator, said the corporation has no comment on potential litigation.
