Man accused of recording women in restroom faces new charges

MORGAN COUNTY, Ind. (WISH) — An Indianapolis man charged with recording videos of women going to the bathroom in his own home was charged with new counts of voyeurism Wednesday.

Justin Behnke of Indianapolis was preliminarily charged on Feb. 25 after police say he had video files on his computer that showed several women in varying states of undress inside his home’s restroom.

At the time, Behnke lived in Avon and worked at the Chili’s restaurant in Martinsville.

On Wednesday, the Morgan County Prosecutor’s Office filed 15 new charges of voyeurism against Behnke for incidents that dated between March and May of 2015.

The Martinsville Police Department said sources in Hendricks County told them that voyeurism by an electronic device may have happened in the women’s restroom at the restaurant.

“Our officers immediately secured the women’s restroom at the Chili’s here in Martinsville and determined there is no current threat to the general public,” Martinsville Police Chief Rick Lang said in February. “We understand the electronic devices belonging to the person of interest were turned over to the Indiana State Police for forensic examinations. The results of those examinations hopefully will reveal whether a crime actually occurred in our jurisdiction or not. This is an ongoing investigation and we are awaiting the results of the examinations to make that determination.”

Chili’s referred to Behnke as a former employee and released this statement:

We are disturbed and saddened after hearing police reports confirming that a former employee secretly hid a recording device in the ladies restroom at our Chili’s in Martinsville.  We have and will continue to work closely with the Martinsville Police Department to fully support their investigation.  Our team members and our guests are our number one concern, and to that end, we confirmed again with the police that they performed a thorough search of our ladies restroom on February 22 and found no recording devices. We hope this does not overshadow the hard work of our Chili’s team members who take care of our guests every day, and we remain committed to providing an enjoyable and safe environment for both our guests and team members in Martinsville.
